Black Lives Matter group holds rally after grand jury decision

McGinty's office on Monday that a grand jury had declined to indict Loehmann - who shot Tamir after responding to a call about "a guy with a gun" at the Cudell Recreation Center - or Garmback, who was driving the police auto.

"People are very upset about it and I believe legitimately and rightfully so", Cleveland Mayor Frank Jackson said of Rice's shooting and other police-involved incidents around the United States.

The grand jury cleared two Cleveland police officers of the November 2014 shooting after hearing weeks of testimony.

"Right here in Wilmington there were four fatalities by law enforcement and no justice was served and this was a national problem as well, but we won't forget, we won't stop until justice is served", Patrick said.

"No justice! No peace!"

Family attorney Subodh Chandra said Samaria Rice wept for much of the day after Cuyahoga County Prosecutor Tim McGinty's announcement that Loehmann and Garmback wouldn't be charged.

"She doesn't know what she can do", Mr Chandra told the Associated Press.

"While the grand jury and the prosecutor have spoken, there remains a multitude of fundamental, unanswered questions".

Loehmann's attorney, Henry Hilow, said the officer bears a heavy burden, too.

"The stereotypes stand in for the actual lived-lives of human beings", Glaude, who is black and a father to a 19-year-old son in college, said in a phone interview Tuesday.

Assistant prosecutor said that it was extremely hard to tell the difference between a pellet gun and a real one which led police officers believe that their lives were in danger forcing them to open fire at Tamir.

"The way prosecutor McGinty has mishandled the grand jury process has compounded the grief of this family", the statement said. The officers have been on restricted duty since the shooting and will remain so through an administrative review police said.

The 911 caller mentioned to dispatch the gun was likely a toy, but that information was never relayed to the officers.

"A reasonable officer would position themselves where they would have some space between themselves and the potential threat where they could have some time and cover", Gilbert said.
